Howdy Bouncy LLC Terms & Conditions
​Use and Responsibility & Disclaimer Warranties: You are responsible for how the rented items are utilized. You agree to defend, indemnify, and hold All Howdy Bouncy LLC harmless from, and hereby release Howdy Bouncy LLC from, all claims for damage to property or bodily injury (including death) resulting from the use, operation, or possession of the items, whether or not it is claimed or determined that such damage or injury resulted in whole or in part from the use, operation, or possession of the items.

Equipment Failure: You agree to immediately stop using rented items if they become unsafe or in disrepair, and you will immediately (within one hour) notify Howdy Bouncy LLC of the situation. Howdy Bouncy LLC agrees, at our discretion, to make the items operable within a reasonable time, or to provide a comparable item only if one is available, or to make a comparable item available at a later time, or to adjust rental rates. This provision does not relieve the renter of their contractual obligations. Howdy Bouncy LLC is not liable for any injuries or damages caused by the failure or defect of a rented item.

Use of Equipment: Renter agrees and covenants to be satisfied with the instruction and condition of rented equipment, as well as the proper and safe use of the equipment, or that renter is so familiar with the equipment and has communicated this to Howdy Bouncy LLC. Renter also agrees that the items will only be used at the address listed on the contract and for the intended and manufactured purpose. The subleasing or improper use of intellectual property is prohibited. Renter acknowledges having read all instruction manuals, operating instructions, and safety notices and rules pertaining to rented items.

The renter is responsible for the equipment from the moment of possession until its return. The renter assumes all loss risk, regardless of cause. If items are lost, stolen, or damaged, the renter is responsible for the replacement or repair costs, including labor. When items are returned dirty, the renter must pay a reasonable cleaning fee.

The renter's right of possession expires at the end of the rental period specified in the rental agreement. The clock is ticking in this contract. Any extension requires a written agreement and adjust rental rates.

Late Returns: Renter must return all the rented items to Howdy Bouncy LLC during regular business hours or hours specified in the rental agreement upon the expiration of the rental period, or as soon as possible thereafter. If the renter fails to return the items on time, the rental rate will continue until the items are returned.

Payment: The renter shall pay all charges payable under this agreement in advance; provided, however, that the foregoing shall not limit the amount payable by the renter under this agreement, and all additional amounts payable under this agreement shall be paid immediately upon incurrence. Renter is responsible for all reasonable collection, court, and attorney fees. If rental fees are not paid within ten days of the due date, Howdy Bouncy LLC reserves the right to recalculate daily rental fees. In addition to other amounts payable hereunder, Renter shall pay a service charge of $2.0 per month on all past due accounts.

Security Deposit: Per standard booking protocol, Howdy Bouncy LLC requires an $80.00 Refundable Security Deposit plus a $5.00 non-refundable transaction fee at the time of reservation. The client will be refunded the Security Deposit specific to the rental item, the Thursday following the rental date and after the Howdy Bouncy LLC team has received and inspected the jump house and/or any other rental item. Howdy Bouncy LLC has the right to non-refund the Security Deposit to cover any excessive damage or staining done while the rental item was in use. Please make sure to adhere to the rules highlighted on our entry sign and in the Howdy Bouncy LLC terms and conditions.​ Payment in full is required before the event's starting time for set up. Howdy Bouncy LLC has the right to deny setup if no payment is received before the event's starting time for setup.
For last-minute events, Full Balance plus Security Deposit and Other Fees are due at the time of booking if the event is being held within seven calendar days.
The Security Deposit and other existing funds for any events cancelled the day of the event, at no fault of Howdy Bouncy LLC, will be forfeited. No refunds will be issued.
Cancellation Within 48 hours prior to the event, will be charged 50% of the Security Deposit and 50% of any other existing funds.

Delivery Fees may apply depending on the location of delivery, please inquire.

​​Rescheduling is not an option seven calendar days before the event date. The new date must be selected before we reschedule the event. Please be advised that we have a fee that will be applied when rescheduling the event.
​
All Items provided for rental by Howdy Bouncy LLC are considered a rental only for the day and time of the event unless otherwise stated in writing and will be picked up undamaged at the time the event ends, unless otherwise, arranged.

All rental equipment provided by Howdy Bouncy LLC may not be moved by anyone other than the Howdy Bouncy LLC team.
​
The client is liable for full value of rented items returned damaged or any missing items . Furthermore, the client is liable for any physical damage for improper use of the rented items.
​
In instances where bad/severe weather conditions arise during the day of the event and/or after delivery/setup, Howdy Bouncy LLC has the right to end the reservation/rental term for the event, and no refund will be given. All rented items are subject to weather conditions.
​
Balloon Artist Services: The client understands that any balloon structure/garland displayed outdoors is not guaranteed to last for any specific amount of time regardless of shade or not and Howdy Bouncy LLC is not responsible for any damages after setting up and no refunds will be issued for installs completed. Furthermore, although inspiration photos are welcome and appreciated, the client understands that no two structures will be the same. Balloons are not rented, they are purchased.

​Additional costs: In addition to other fees and costs outlined in this agreement, the renter shall pay the company's then-current rates for the following services. Delivery and/or Pickup to any location other than level ground incurs an additional fee. Install tables and chairs.
Delivery and Pickup outside of business hours, on weekends and holidays. None of the packaging materials were returned. Assistance calls. Site investigation and preparation. Delivery & Pickup: The renter shall clean and repackage (in original packaging) the rented items, and if Howdy Bouncy LLC agrees to pick up the item, the renter shall make it available for pick up at a mutually agreed upon and easily accessible location. Howdy Bouncy LLC will deliver and pick up the equipment at its convenience and at the time specified. The renter agrees to pay a service fee for each additional delivery or pickup call that Howdy Bouncy LLC must make. Renter shall make its personnel available at the designated time for the assistance and collection of all items.
In addition to its other obligations under this Agreement, the Renter shall: Pay a reasonable cleaning fee for items returned dirty. Protect the rented items against weather damage, breakage, unauthorized or improper use, theft, and loss while they are in the renter's possession.
Insurance: Renter shall maintain, at renter's expense, liability, property, and casualty insurance in an amount sufficient to protect Howdy Bouncy LLC and its equipment against all claims, loss, or damage. In the event of loss or damage, you shall exercise and authorize us to exercise all of your rights to recover under insurance, and you shall cooperate with Howdy Bouncy LLC to recover. Howdy Bouncy LLC should receive or be assigned all insurance proceeds.
Site Preparation: Renter agrees to have site cleaned and ready for delivery and installation as well as for pickup of the equipment.
Permits & Licenses: Prior to any installation of rental equipment, including tents, the renter agrees to secure, at their own expense, all necessary permits, licenses, and other consents.
Subsurface Conditions: The renter agrees to locate any buried utilities prior to the delivery of rented items. Additionally, the renter agrees to reimburse Howdy Bouncy LLC for any additional expenses incurred as a result of hidden or subsurface conditions. During tent and/or inflatable setups, Howdy Bouncy LLC is NOT responsible for any damage to underground sprinkler systems. To prevent damage to a sprinkler line, it is the customer's responsibility to provide Howdy Bouncy LLC with a sprinkler line layout. Even with a line layout, however, there are no guarantees.
Hold Harmless Agreement: Renter accepts all risk, and agrees to hold Howdy Bouncy LLC and any of its employees harmless from and against any and all claims, losses, liabilities, and damage, and all costs and expenses arising directly or indirectly at or relating to: The delivery, loading, unloading, erection, installation, disassembly, and use of rented equipment. Contact with underground utilities, pipes, or any other condition on the property of the tenant. All required surface maintenance. Any injuries or damages sustained while using rented equipment, such as inflatables, dunk tanks, and interactive games.
Poor weather and strong winds: In the event of inclement weather, the Host agrees to contact Howdy Bouncy LLC no later than 48 hours before the event to arrange a reschedule of the event for a later date. Howdy Bouncy LLC has the right to ask for a reschedule of date if it’s unsafe to install or deliver the rental equipment. For instance, winds over 10 miles per hour will allow Howdy Bouncy to cancel a tent or inflatable.
Damage Waiver: If you agree to the damage waiver fee as specified, and subject to the limitations and exclusions listed below, Howdy Bouncy LLC will modify the terms of this agreement and release you from liability for accidental damage to the rented item(s) on this contract, as well as loss due to fire, collision, windstorm, upset, or riot. We exclude from this waiver, however, any loss or damage resulting from theft, misuse, or abuse, by conversion, intentional damage, mysterious disappearance, or other loss attributable to your neglect of the rented item (s).
Replacement cost: The customer will be responsible for paying the replacement cost of the item, which will be determined by the seller. The customer must notify the seller immediately if the item is lost, stolen or damaged. The customer must pay for the replacement cost of the item within 30 days of notification. The customer will not be entitled to a refund for the lost, stolen or damaged item.
